RELEASE AND WAIVER OF LIABILITY AGREEMENT

Facility: Arena Athletics, Davao City
Covered Areas: Building 2 (24/7), Building 3, and Temporary Amenities

By clicking "I AGREE" or signing this document, I (the "Participant") acknowledge and agree to the following terms:

1. Assumption of Risk

I understand and accept that participating in Pickleball, Badminton, or any physical activity involves inherent risks, including but not limited to:

Physical injury (sprains, fractures, or cardiac events).
Tripping or falling on court surfaces.
Injuries from sports equipment (rackets, paddles, balls, or shuttlecocks).
Risks associated with 24-hour facility use (e.g., late-night travel or reduced staff presence).

2. Construction Site Notice

I acknowledge that the Amenities Building is currently under construction (Target Completion: Q3 2026). I agree to stay clear of all cordoned-off construction zones, scaffolding, and heavy machinery. Arena Athletics is not liable for injuries resulting from unauthorized or negligent entry into construction areas.

3. Medical Fitness

I certify that I am in good physical health and have no medical conditions that would prevent me from safely participating in sports. I assume full responsibility for monitoring my own physical limits and seeking medical clearance if necessary.

4. Release and Indemnity

I hereby release, waive, and discharge Arena Athletics, its owners, employees, agents, and contractors from any and all liability, claims, demands, or causes of action for personal injury, property damage, or wrongful death arising out of my use of the facility, whether caused by negligence or otherwise.

5. Equipment & Property

I agree to pay for any damage caused to the facility or rental equipment due to my negligence, misuse, or willful misconduct.
Arena Athletics is not responsible for any lost, stolen, or damaged personal belongings within the premises or the parking area.

6. Photo & Video Release

I grant Arena Athletics the right to use my image or likeness captured via CCTV or promotional photography within the facility for security, documentation, and marketing purposes.

7. Emergency Consent

In the event of an emergency, I authorize Arena Athletics staff to secure medical treatment or transport for me if I am unable to do so myself. I agree to be responsible for all costs associated with such medical care.

FOR MINORS (Under 18)

The minor must be accompanied by a parent or guardian. The parent or guardian is required to sign a hard copy of this waiver, at the reception area, prior to the minor’s participation. Failure to provide a signed waiver will result in the minor being unable to participate. The guardian assumes all risks and obligations listed above and agrees to indemnify Arena Athletics against any claims arising from the minor’s participation.
